1. Acceptance of Terms

By accessing or using the HomeFig platform operated by Home Design Technologies Inc. ("HomeFig," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Description of Service

HomeFig is an interior design planning tool that enables users to create floor plans, configure rooms, select real products, and visualize their designs in 3D. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Account Terms

• You must be at least 13 years of age to use this service.
• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account and password. Authentication is provided through Clerk and, optionally, Google OAuth.
• You are responsible for all activity that occurs under your account.
• One person may not maintain more than one account.
• You must notify us immediately of any unauthorized use of your account.

4. Analytics and Cookies

By creating an account, you consent to the use of analytics cookies to help us understand how you use HomeFig and improve the service. 5. Permitted Use

You agree that you will not:

• Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble any part of the service.
• Use automated systems, bots, or scrapers to access the service without our prior written permission.
• Interfere with or disrupt the integrity or performance of the service.
• Attempt to gain unauthorized access to the service or its related systems.
• Upload or transmit viruses, malware, or other harmful code.

6. User Content

Ownership. You retain all rights to the designs, floor plans, and other content you create using HomeFig ("User Content").

License to HomeFig. By using our service, you grant us a limited, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of providing and improving the service. This license terminates when you delete your content or account.

Responsibility. You are solely responsible for any content you create or upload through the service and represent that you have the necessary rights to do so.

7. Intellectual Property

The HomeFig service, including its original content, features, functionality, branding, product catalog data, and 3D models, is and will remain the exclusive property of Home Design Technologies Inc. Our service is protected by copyright, trademark, and other intellectual property laws. Nothing in these terms grants you any right to use our trademarks, logos, or other brand features beyond normal use of the service.

8. Payment and Subscription

Certain features of HomeFig may require a paid subscription. If applicable, you agree to pay the fees associated with the plan you select. We reserve the right to change pricing with reasonable notice. Details of paid plans, billing cycles, and cancellation policies will be provided at the time of purchase.

9. Termination

We may suspend or terminate your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties.

You may delete your account at any time. Upon termination, your right to use the service will immediately cease. We may retain anonymized data as described in our Privacy Policy.

10. Disclaimers

The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, or error-free. Design visualizations and product representations are for planning purposes only and should not be considered professional architectural or design advice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Home Design Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the service.

Our total aggregate liability for all claims related to the service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Home Design Technologies Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the service, your violation of these terms, or your violation of any third-party rights.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.

14. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Effective Date" at the top. Your continued use of the service after any changes constitutes your acceptance of the updated terms.
